Entry Of Nolle Prosequi - The Republic Vs. Mahama Ayariga And Another

Following a thorough review of the available evidence, the OP has entered a nolle prosequi in respect of all the charges and counts against both accused persons on the following grounds:

 

(a) Upon further scrutiny of the available evidence, the Republic would be unable to prove its case on the standard of proof required in a criminal case, viz. beyond reasonable doubt.

 

(b) The present case appears certain to suffer the same fate as Case No. FT/012/2019, the Republic v. Hajia Haw Ninchema & Six Others, which was dismissed on 7 May 2021 on a submission of no case to answer.

 

The OSP is a specialized prosecutorial anti-graft agency. We prevent, investigate, and prosecute cases involving corruption and corruption-related offences. We also trace and recover the proceeds of crime. Under the leadership of the Special Prosecutor, Kissi Agyebeng, the OP is poised to make corruption a costly venture in Ghana.

Member of Parliament for Bawku Central had been facing two separate actions by the State. He was acquitted and discharged in the first case, Case No. FT/012/2019, The Republic v. Hajia Hawa Ninchema & Six Others in respect of alleged procurement breaches in the purchase of an ambulance for his constituency.

 

The first accused person in the second case, Mahama Ayariga, on 11 August 2019 was charged with five counts of using public office for private benefit, using public office in the purchase of a brand new and second-hand Toyota Landcruiser vehicle. The second accused person, in the second case, Kendrick Akwasi Marfo, a car rental dealer was charged with one count of collaboration with a public officer for the public officer's private profit.
